New standards: EU judgement sets new requirements for time tracking at Danish companies

New times are coming for Danish companies

Time tracking will soon become a part of everyday life. This is based on the EU judgement on recording working time that was handed down in May 2019, and although it has not yet been ratified in Denmark, employers may want to start exploring the possibilities of a time tracking system. This is because it is largely the responsibility of companies to ensure they comply with the new EU judgement.

The EU ruling requires member states to ensure that employers have a system for recording all employees” daily working hours, as this is necessary to monitor and ensure compliance with the EU Labour Directive. According to the EU judgement, companies must put in place ”reliable, objective and accessible systems" that make it easy to keep track of each employee's working hours. The reason for this EU ruling can be found in the EU Labour Directive (Directive 2003/88/EC), which sets the framework for how long working days and how much holiday a worker in Europe should have.

It is up to each country to implement this new framework in national legislation, which means we are now waiting for the Danish government and labour market partners to find a solution on how this can be implemented with the current Working Environment Act and collective agreements. Regardless of how the EU judgement is implemented in Denmark, it will certainly have an impact on all Danish companies.
